Political Prosecution of the Bateragune Case

That the Parliament notes with concern the decision of the Spanish Supreme Court to repeat the trial of Arnaldo Otegi, Rafa Díez, Sonia Hacinto, Miren Zabaleta and Arkaitz Rodríguez in the Bateragune case; understands that the European Court of Human Rights ruled that the original trial for being members of ETA in 2011 was unfair and in violation of the defendants’ human rights; recognises that all five have already served the entirety of the sentences handed down to them in the original trial; understands that the decision to reopen the case came following a request from the far-right Spanish party, VOX; condemns political interference in the judicial process; believes that the World Economic Forum ranked Spain 56th in the world for judicial independence, behind countries including China and Saudi Arabia, and calls on the EU to intervene to uphold the rule of law and human rights in Spain.
